1. Acceptance of Terms

By accessing or using 312built.com(“the Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Site.312 Built(“we,” “us,” or “our”) reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

312 Built is a contractor directory for the Chicagoland area. We provide:

• A searchable directory of home service contractors evaluated through our data-driven vetting process
• Contractor profiles with ratings, reviews, specialties, and service areas
• A consultation request system that connects homeowners with contractors
• Tools for contractors to claim and manage their profiles

3. Directory Information

Contractor listings on 312 Built are generated from publicly available data, including Google Business profiles and reviews. While we take care to ensure accuracy through our multi-step vetting process, we make no guarantees that all information is complete, current, or error-free.

Tier designations (Featured, Verified, Listed) are based on our internal quality scoring methodology and reflect data-driven assessments — not endorsements, certifications, or guarantees of quality. Tiers may change as new data becomes available.

Ratings and reviews displayed on the Site are sourced from Google and reflect the opinions of individual reviewers. 312 Built does not verify the accuracy of individual reviews and is not responsible for their content.

4. Consultation Requests

When you submit a consultation request through the Site, you agree to the following:

• You are providing accurate contact information and project details
• The contractor you selected will receive your name, phone number, email, zip code, and project description so they can contact you
• 312 Built facilitates the introduction but is not a party to any agreement, contract, or transaction between you and the contractor
• 312 Built is not responsible for the quality, timeliness, pricing, or outcome of any work performed by a contractor

5. Contractor Accounts & Subscriptions

Contractors may claim their profiles by verifying their identity and business information. Some features on the Site may require a paid subscription.

5.1. Free & Paid Tiers

We offer both free and paid subscription tiers. Paid tiers may offer additional features such as enhanced profile visibility, lead access, or analytics. We reserve the right to modify the features offered in each tier at any time.

5.2. Billing & Payments

By subscribing to a paid plan, you agree to pay all applicable fees. Payments are processed securely through our third-party payment processor (Stripe). We do not store your credit card information directly. Subscriptions automatically renew at the end of each billing period unless canceled.

5.3. Cancellations & Refunds

You may cancel your subscription at any time through your dashboard. Cancellation will take effect at the end of your current billing period. All fees are non-refundable, and we do not provide refunds or credits for partially used billing periods.

5.4. Contractor Conduct

By claiming a profile, contractors agree to:

• Provide accurate and current business information
• Respond to consultation requests in a timely and professional manner
• Not misrepresent their services, qualifications, or credentials
• Accept that 312 Built may adjust their tier designation based on updated data

We reserve the right to suspend or remove any contractor listing that violates these terms or that we believe misrepresents the contractor's services, without refund.

6. Community Contributions & User-Generated Content

312 Builtallows registered users to submit project pricing data, contractor reviews, and other information through our community features (including “Share What You Paid” and the Community Leaderboard). By submitting content, you agree to the following:

• Accuracy: you certify that the information you submit is truthful and based on your genuine personal experience with a contractor
• License: you grant 312 Built a perpetual, non-exclusive, royalty-free, worldwide license to use, display, aggregate, and publish your submitted data (including pricing information, project details, and satisfaction ratings) on the Site and in marketing materials
• Public display: your chosen display name and submission data (project type, zip code, price, satisfaction) may be displayed publicly. Your email address and account identity are never shown.
• No compensation: submissions are voluntary. Points earned through the community leaderboard have no cash value. Any prizes, raffles, or rewards are offered at our sole discretion and may be modified or discontinued at any time.
• Moderation: we review all submissions before publishing and may edit, reject, or remove content at our sole discretion without notice
• No guarantees: community-submitted pricing data is informational only and does not constitute a quote, estimate, or guarantee of pricing for any contractor or service
• Prohibition on abuse: submitting false, misleading, defamatory, or spam content may result in account suspension. Submitting fabricated pricing data to harm a contractor's reputation is prohibited.

7. Intellectual Property

The Site's design, layout, text, graphics, logos, and software are owned by 312 Builtand protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from the Site's content without our written permission.

Contractor data displayed on the Site (names, ratings, reviews) is sourced from public records and third-party platforms. 312 Built's original analysis, quality scores, tier designations, profile descriptions, and editorial content are our intellectual property.

8. Prohibited Uses

You agree not to:

• Scrape, crawl, or automatically collect data from the Site beyond what is permitted by our robots.txt
• Submit false, misleading, or spam consultation requests
• Impersonate a contractor or claim a profile that is not yours
• Attempt to interfere with the Site's operation, security, or infrastructure
• Use the Site for any unlawful purpose

9. Analytics & Tracking

By using the Site, you acknowledge that we use the following third-party tools:

• Plausible Analytics: a privacy-friendly, cookie-free analytics service that collects anonymized usage data (page views, referrers, device type). No personal data is collected.
• Meta (Facebook) Pixel: used to measure advertising effectiveness and create targeted audiences on Facebook and Instagram. The Pixel may collect browsing data and set cookies on your device. You may opt out via your Facebook Ad Settings.

10. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

• The Site will be uninterrupted, error-free, or secure
• Contractor information will be accurate, complete, or current
• Any contractor will meet your expectations or provide satisfactory service
• Results obtained through the Site will be reliable

You acknowledge that hiring a contractor involves inherent risks and that you are solely responsible for verifying a contractor's qualifications, licenses, insurance, and references before entering into any agreement.

11. Limitation of Liability

To the fullest extent permitted by law, 312 Built shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Site or any contractor engagement facilitated through the Site.

Our total liability for any claim arising from your use of the Site shall not exceed $100.

12. Indemnification

You agree to indemnify and hold harmless 312 Built, its owners, operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Site, your violation of these Terms, or your interaction with any contractor.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts located in Cook County, Illinois.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
